Terms and Conditions

This is a legal contract (referred to hereinafter as the "Plan"). By purchasing it, you understand that it is such a contract and acknowledge that you have had the opportunity to read the terms and conditions set forth herein. This Plan is not a contract of insurance. By purchasing this Plan you are consenting to N.E.W. Customer Service Companies of Canada, Corp's collection, use and disclosure of personal information as described below, including its ability to share your personal information with LensCrafters the seller of this Plan.

Obligor: The companies obligated under this Plan are as follows: In all provinces except British Columbia, the obligor is N.E.W. Customer Service Companies of Canada, Corp, whose address is 900-1959 Upper Water Street, Halifax NS B3J 3N2 Canada, telephone 1-866-856-3882. In British Columbia, the obligor is Continental Casualty Company, Canadian Branch, whose address is 250 Yonge Street, Suite 1500, Toronto, ON M5B2L7, Canada, telephone 800-831-4262.

Instructions: You must keep the Plan and the sales receipt for this product; it is an integral part of this Plan and you may be required to reference it to obtain service. This Plan, including the terms, conditions, limitations, exceptions and exclusions, the sales receipt containing the term of this Plan, the price you paid for this plan, commencement date and product identification, constitute the entire agreement.

Definitions: Throughout this Plan the words (1) "we," "us," or "our" refer to the company obligated under this Plan, as referenced in the Obligor section ; (2) "administrator" refers to N.E.W. Customer Service Companies of Canada, Corporation ("NEW"). The administrator can be contacted at: 900-1959 Upper Water Street, Halifax NS B3J 3N2 Canada; (3) "retailer" refers to LensCrafters; (4) "breakdown" refers to the failure of the product caused by: (a) defects in workmanship and/or materials, (b) normal wear and tear and (c) unintentional and accidental damage from handling (ADH); (5) "product" refers to the consumer item which you purchased concurrently with and is covered by this Plan; (6) "you," "your," and "service contract holder" refer to the individual who purchased the product and this Plan; (7) "co-pay" refers to the amount of money you are required to pay the retailer as set forth in the Co-Pay section of this Plan.

What is Covered: This Plan covers parts and labour costs to repair your product in the event your product experiences a breakdown which is not covered under any other warranty or service contract. We will repair or replace the product, at our discretion, when required due to a breakdown. Non-original manufacturer's parts may be used for repair of the product if the manufacturer's parts are unavailable or more costly. You are responsible for delivery or the cost of delivery of your product to the authorized service centre for repair, per our instructions. There may be a co-pay, see the Co-Pay section below for more information. If the covered product cannot be repaired, if the cost of the repair exceeds the original purchase price, or if parts are no longer available due to the age of the product or due to discontinuance by the manufacturer, we will replace your product with a product of like kind and quality that performs to the factory specifications of the original product. At our sole discretion, we may require that you return the covered product to a designated location as a condition to receiving a replacement product.

Term of Coverage: Your term and coverage commences on your date of purchase and continues for the period indicated on your sales receipt. The term of this plan will be extended an additional two (2) weeks to accommodate for the preparation of your product.

Deductible: There is no deductible for this Plan; however, there may be a co-pay. Please refer to the Co-Pay section for more details.

Co-Pay: If your product requires the following services, the retailer will collect the following from you based on the service you receive: New frames = $25; New lenses = $25; New frames and new lenses = $25.

WHAT IS NOT COVERED:

(1) INCIDENTAL OR CONSEQUENTIAL DAMAGES INCLUDING BUT NOT LIMITED TO ANY DELAY IN RENDERING SERVICE UNDER THIS PLAN OR LOSS OF USE DURING THE PERIOD THAT THE PRODUCT IS AT A REPAIR CENTRE OR OTHERWISE AWAITING PARTS; (2) ANY AND ALL PRE-EXISTING CONDITIONS THAT OCCUR PRIOR TO THE EFFECTIVE DATE OF THIS PLAN; (3) DAMAGE FROM ABUSE, INTRODUCTION OF FOREIGN OBJECTS INTO THE PRODUCT, UNAUTHORIZED PRODUCT MODIFICATIONS OR ALTERATIONS; (4) FAILURE TO FOLLOW THE MANUFACTURER'S CLEANING AND CARE INSTRUCTIONS; (5) THIRD-PARTY ACTIONS (FIRE, COLLISION, VANDALISM, THEFT, ETC.); (6) LOSS OR DAMAGE DUE TO THE ELEMENTS OR ACTS OF GOD; (7) LOSS OR DAMAGE DUE TO WAR, INVASION OR ACT OF FOREIGN ENEMY, HOSTILITIES, CIVIL WAR, REBELLION, RIOT, STRIKE, LABOUR DISTURBANCE, LOCKOUT OR CIVIL COMMOTION; (8) DAMAGE COVERED BY ANY OTHER WARRANTY OR SERVICE CONTRACT; (9) PRODUCTS NOT ORIGINALLY COVERED BY A MANUFACTURER'S WARRANTY OR RETAILER'S STORE RETURN POLICY; (10) PREVENTATIVE MAINTENANCE; (11) DAMAGE WHICH IS NOT REPORTED WITHIN THIRTY (30) DAYS AFTER EXPIRY OF THIS PLAN; (12) ANY LOSS OTHER THAN A COVERED BREAKDOWN OF THE PRODUCT; (13) DECORATIVE EMBELLISHMENTS AND/OR ACCESSORIES ATTACHED TO THE PRODUCT; (14) DAMAGE CAUSED BY ANIMALS AND INSECTS; (15) UNAUTHORIZED REPAIRS; (16) SERVICE THAT OCCURS OUTSIDE CANADA; (17) DAMAGE INCURRED DURING TRANSPORTATION; (18) PRODUCTS SOLD "AS IS" INCLUDING BUT NOT LIMITED TO FLOOR MODELS (UNLESS COVERED BY A FULL MANUFACTURER'S WARRANTY ON YOUR DATE OF PURCHASE) AND DEMONSTRATION MODELS; (19) DAMAGE FROM TAMPERING WITH ELEMENTS DESIGNED TO SECURE LENSES AND/OR ARMS, OR UNAUTHORIZED PRODUCT MODIFICATIONS OR ALTERATIONS; (20) PRODUCTS THAT ARE LOST OR STOLEN; (21) EYE EXAMS OR OTHER MEDICAL EXPENSES ASSOCIATED WITH OBTAINING REPLACEMENT EYEWEAR; (22) CLEANINGS, ADJUSTMENTS, AND FITTINGS; AND (23) REPAIR OR REPLACEMENT OF EYEWEAR DUE TO OUTGROWTH OF EYEWEAR, A CHANGE IN OPTICAL PRESCRIPTION OR ANY OTHER MEDICAL REASON.

Transfer: This Plan is non-transferable.

Renewal: This Plan is not renewable.

Cancellation: This Plan can be cancelled by you at any time for any reason by providing written notice and a copy of your Plan to the retailer at the address where you purchased this Plan. You may also cancel this Plan by providing written notice to NEW at NEW (LensCrafters), PO Box 1818, Sterling, VA 20167, USA. If the Plan is cancelled by either party: (a) within thirty (30) days of the receipt of this Plan, you shall receive a full refund of the price paid for the Plan, provided no service has been performed, or (b) thirty (30) days after the receipt of this Plan, you will receive a pro rata refund, less the cost of any service received. This Plan shall be cancelled by us or NEW for fraud or material misrepresentation, including but not limited to commercial or rental use. Unauthorized repair or replacement of covered equipment shall result in the cancellation of this Plan by us. In the event of cancellation by us, written notice of cancellation shall be mailed to you not less than sixty (60) days before cancellation is effective.

Province or Territory Variations: The following provincial or territorial variations shall prevail if inconsistent with any other provisions:

In British Columbia, by virtue of this Plan being an executory contract under the British Columbia Consumer Protection Act, the following cancellation rights apply:

Notice of Right of Cancellation (Contract for Future Services)
(Section 11(7) of the Consumer Protection Act)

(a) This is a Plan to which the Consumer Protection Act of British Columbia applies.
(b) You, the buyer, may cancel this Plan by giving notice of cancellation not later than ten (10) days after the date you receive a copy of this Plan. It is not necessary to give a reason for cancellation.
(c) You can send a notice of cancellation to the administrator.
(d) You must give notice of cancellation by a method that will allow you to prove that you gave notice, including registered mail, fax, electronic mail or personal delivery.
(e) If you send the notice of cancellation by mail, fax or electronic mail, it doesn't matter if the retailer receives the notice after the ten (10) day period as long as you sent it within the ten (10) day period.

In Ontario, by virtue of this Plan being an executory contract under the Ontario Consumer Protection Act, and in Manitoba, Nova Scotia, Prince Edward Island and Newfoundland and Labrador, the following cancellation rights apply:

BUYER'S RIGHT TO CANCEL
You may cancel this Plan from the day you enter the Plan until ten (10) days after you receive a copy of this Plan. You do not need a reason to cancel.

If you do not receive the goods or services within thirty (30) days of the date stated in the Plan, you may cancel this Plan within one (1) year of the Plan date. You lose that right if you accept delivery after the thirty (30) days. There are other grounds for extended cancellation. For more information, you may contact your provincial/territorial consumer affairs office.

If you cancel this Plan, the retailer has fifteen (15) days to refund your money and any trade-in, or the cash value of the trade-in. You must then return the goods.

To cancel, you must give notice of cancellation at the address of the administrator (above in this Plan). You must give notice of cancellation by a method that will allow you to prove that you gave notice, including registered mail, fax, or personal delivery.

In Quebec, the following cancellation rights apply:

STATEMENT OF CONSUMER CANCELLATION RIGHTS
(Consumer Protection Act, section 58)

You may cancel this Plan for any reason within ten (10) days after you receive a copy of the Plan along with the other required documents.

If you do not receive the goods or services within thirty (30) days of the date stated in the Plan, you may cancel the Plan within one (1) year. You lose that right if you accept delivery after the thirty (30) days. There are other grounds for an extension of the cancellation period to one (1) year, for example if the retailer does not hold a permit or has not provided the required security at the time the Plan is made, if the goods are never delivered or the services never performed, or if the Plan is incorrectly made or worded. For more information, you may seek legal advice or contact the Office de la protection du consommateur.

If you cancel the Plan, the retailer must refund all amounts you have paid, and return to you the goods received in payment, as a trade-in or on account; if the retailer is unable to return the goods, you are entitled to receive an amount of money corresponding to the value indicated in the Plan or the cash value of the goods, within fifteen (15) days of cancellation. You also have fifteen (15) days to return to the retailer any goods you received from the retailer.

To cancel, you must return the items received from the retailer to the retailer or the retailer's representative, send the retailer the cancellation form attached, or send the retailer written notice of cancellation. The form or written notice must be sent to the retailer or the retailer's representative at the address indicated on the form, or at any other address indicated in the Plan. You must give notice of cancellation by personal delivery or by any other method that will allow you to prove that you gave notice, including registered mail, e-mail, fax and courier.
